1. Scope of Application

  1. These Terms and Conditions (hereinafter referred to as "T&Cs") of "Xircado Berlin" (hereinafter referred to as the "Seller") apply to all contracts that a consumer or entrepreneur (hereinafter referred to as the "Customer") concludes with the Seller regarding the goods offered by the Seller in its online shop. The inclusion of the Customer’s own conditions is hereby objected to, unless otherwise agreed.
  2. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
  3. An entrepreneur is a natural or legal person or a partnership with legal capacity who acts in the exercise of their trade, business, or profession when concluding a legal transaction.

2. Conclusion of the Contract

  1. The presentation of goods, especially in the online shop, does not yet constitute a binding offer by the Seller.
  2. First, the Customer places the selected goods in the shopping cart. In the subsequent step, the ordering process begins, in which all the data necessary for order processing is recorded. At the end of the ordering process, a summary of the order, payment, and contract details appears. Only after confirming this summary by clicking the button to complete the order, the Customer makes a binding offer to purchase the goods in the shopping cart.
  3. The Seller accepts the Customer's offer through the following possible alternatives:
    • Sending a written order confirmation or an order confirmation via email
    • Requesting payment from the Customer after the order has been placed
    • Delivery of the ordered goods
  4. The contract text of the respective contract between the Seller and the Customer is stored by the Seller. The Customer can view the Terms and Conditions at any time on this page.

3. Prices and Payment Terms

  1. The displayed prices are final prices, including statutory VAT, unless otherwise agreed. If additional shipping costs apply, this will be stated in the product description.
  2. If delivery is made to non-EU countries, further duties, taxes, or fees may be payable by the Customer to the customs or tax authorities or to credit institutions.
  3. The Customer can choose from the payment methods available in the online shop. These are credit card, PayPal, Google Pay, and Apple Pay.

4. Delivery and Shipping Conditions

  1. The delivery of goods by shipping is made to the delivery address specified by the Customer.
  2. If the Seller incurs additional costs due to the provision of an incorrect delivery address, these costs shall be reimbursed by the Customer.

5. Right of Withdrawal

  1. If the Customer is a consumer, they generally have a right of withdrawal. Exceptions apply to goods that are custom-made for the Customer based on color selection at the time of ordering (tags).
  2. The Seller's cancellation policy applies to the right of withdrawal.

6. Retention of Title

If the Seller makes an advance delivery, the goods remain the property of the Seller until full payment of the purchase price has been made.

7. Liability for Defects

The statutory provisions on liability for defects apply, unless otherwise agreed.

8. Applicable Law

The law of the Federal Republic of Germany applies, excluding the laws on the international sale of goods.

9. Place of Jurisdiction

If the Customer is a merchant, the exclusive place of jurisdiction for all disputes arising from this contract is the Seller's place of business.

10. Information on Online Dispute Resolution

The EU Commission's platform for online dispute resolution is available at the following link: https://ec.europa.eu/odr.

We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
